Terms and condition for booking a stay at KYO Hostel
OCCUPANCY
Guest agrees that no more than the specified number of persons at the time of booking shall be permitted in the room at any time during the Booking Term. All guests must comply with the conditions and restrictions outlined in this Agreement.
CONDITION AND USE OF HOSTEL
The Hostel is provided in “as is” condition. Hostel Management will endeavor to ensure the operation of all amenities such as internet access, TV access, and other services. Hostel Management is not liable for the failure of these amenities but will promptly address any reported issues. Guest acknowledges that the use of amenities may involve risks, especially for children, and uses them at their own risk.
Guest shall use the Hostel for residential purposes only, ensuring the Hostel is kept clean and sanitary at all times. Guests and permitted visitors must avoid loud noise and refrain from disturbing neighbors. The Hostel shall not be used for immoral, offensive, or unlawful purposes, nor violate any laws, association rules, or ordinances, or cause nuisance or waste.
DEFAULT
If Guest fails to comply with the conditions and obligations of this Agreement, Guest shall vacate the Hostel, remove all belongings, and leave it undamaged. No refund of the Total Booking Fee shall be made. The prevailing party in any legal action shall be reimbursed for all incurred costs.
ASSIGNMENT OR SUBLEASE
Guest shall not assign or sublease the Hostel or allow use by others not included as family or guests under this Agreement.
RISK OF LOSS AND INDEMNIFICATION
Guest agrees that personal property, furnishings, and items brought into the Hostel are at their own risk regarding theft, damage, or loss. Hostel Management is not liable for any loss.
Guest indemnifies and holds harmless Hostel Management, its agents, owners, and employees from costs, damages, claims, legal fees, or other actions related to property destruction, injury, or loss of life of Guest, family, or visitors at the Hostel.
RELEASE
Guest waives claims against Hostel Management, the owner, successors, assigns, or representatives for injuries or death sustained on or near the Hostel premises, including facilities, activities, or amenities. Guest uses facilities and amenities at their own risk.
ENTRY AND INSPECTION
Hostel Management may enter the Hostel at reasonable times with advance notice to inspect or show to prospective renters. In emergencies, entry may occur without notice.
UNAVAILABILITY OF HOSTEL
If the Hostel is unavailable during the Booking Term due to reasons beyond Hostel Management’s control, efforts will be made to find a comparable replacement. If none is found, all payments will be returned, terminating this Agreement.
CANCELLATION
Kyo Surf Hostel advises all clients to secure travel insurance to cover unforeseen cicumstances that may result in cancellations. Our cancellation policy aligns with that of our booking provider, Banandesk: cancellations made more than 5 days prior to check-in are eligible for a refund of the 4% confirmation fee. Cancellations made between 48 hours and 5 days before check-in will not receive a refund for the commission, but no additional penalties will be applied. For cancellations within 48 hours of check-in or no-shows, the first night’s stay will be charged as a penalty and credited to your next Banandesk bill.
Please note that this cancellation policy does not apply if your stay has been booked through other companies. In such cases, you must contact the company through which you booked your stay for their cancellation policy.
RESPONSIBILITIES
Kyo Surf Hostel does not accept any responsibilities or offer refunds under the following circumstances:
We highly recommend having travel insurance to cover any damage to personal items or losses.
SUMMARY
Clients are expected to adhere to the regulations and rules of our hostel and in cases of irresponsible behavior, Kyo Surf Hostel will take necessary steps to prevent any further problems.
By booking and paying for services at the hostel, you automatically accept the preceding Terms and Conditions.
